Terms of Service
Last updated: October 17, 2026
These Terms of Service ("Terms") govern your use of CallbackGenie, a missed-call text-back and callback service provided by CallbackGenie ("CallbackGenie", "we", "us"), located in British Columbia, Canada. By creating an account or using the service, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you have authority to bind that business, and "you" means that business.
1. The service
CallbackGenie gives your business a local phone number. When you miss a call to that number, we automatically text the caller with callback options, notify you of their choice, and at the chosen time call you so you can connect to the caller with a single key press. Paid plans and their features are described on our website and in your account.
The service relies on telephone carriers and third-party providers. We do not guarantee that every call, text or email will be delivered or delivered on time, and callback timing may vary by several minutes. CallbackGenie is not an emergency service and must not be relied on for emergency or time-critical calls.
2. Who can use it
CallbackGenie is a business service. You must be at least the age of majority in your province or territory and use the service for business purposes. You agree to give us accurate account and business information and keep it up to date, including any information carriers require to register your number for business texting.
3. Your account
You are responsible for keeping your password confidential and for all activity under your account. Tell us promptly at callbackgenie@gmail.com if you believe your account has been accessed without permission.
4. Plans, billing and automatic renewal
- Plans are billed monthly, in advance, in Canadian dollars, starting on the day you subscribe.
- Your subscription renews automatically each month and your payment method is charged until you cancel.
- Payments are processed by Stripe. We do not receive or store your full card number.
- Prices exclude applicable taxes (such as GST/PST), which will be added where required.
- Setup is free unless your plan says otherwise.
- We may change prices with at least 30 days' notice by email. A new price applies from your next billing date after the notice period. If you don't agree, you may cancel before it takes effect.
- If a payment fails, we may retry it and may suspend the service until your account is paid up.
5. Changing plans, cancelling and refunds
You can switch plans or cancel anytime from your account under Manage billing. When you switch plans, the price difference is prorated for the rest of the billing period. When you cancel, the service continues until the end of the period you have already paid for and then stops; you will not be charged again. Except where required by law, fees already paid are not refundable, including for partial months or unused features.
6. Your phone number
The phone number we provide remains assigned to your account while your subscription is active. After your subscription ends we may release the number, typically after 30 days. If you want to keep the number, contact us before cancelling and we will help you transfer it where the carrier allows.
7. Your responsibilities and acceptable use
Messages and calls sent through CallbackGenie are sent on your behalf. You are responsible for how you use the service and for complying with applicable laws, including Canada's Anti-Spam Legislation (CASL), CRTC rules, privacy laws, and any similar laws where your callers are located. In particular, you are responsible for having any consent required to send commercial messages, such as review requests or thank-you emails, to your customers. You agree not to:
- use the service to send spam, unsolicited marketing or misleading messages;
- send unlawful, harassing, threatening, hateful or fraudulent content;
- impersonate another person or business;
- interfere with, overload, reverse engineer or attempt to gain unauthorized access to the service; or
- resell or share the service without our written permission.
8. Your data
You own the information about your business and your callers that passes through the service ("Customer Data"). You authorize us to use Customer Data only to provide, maintain and support the service and as described in our Privacy Policy. You confirm you have the right to provide Customer Data to us for these purposes.
9. Third-party services
The service uses third-party providers, including for payments (Stripe), telephony and messaging, email delivery and hosting. Your use of features that depend on these providers may also be subject to their terms. We are not responsible for outages or failures of third-party services, but we will work to restore the service as quickly as reasonably possible.
10. Changes to the service
We may improve, change or discontinue features from time to time. If we make a change that materially reduces your plan's core features, we will give you reasonable notice, and you may cancel.
11. Suspension and termination
We may suspend or close your account if you breach these Terms, fail to pay, use the service in a way that could harm others or expose us to legal risk, or if a carrier requires it. Where reasonable, we will give you notice and a chance to fix the issue first. Sections that by their nature should survive termination (including billing, disclaimers, limitation of liability and governing law) survive.
12. Disclaimers
To the extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not promise that the service will be uninterrupted or error-free, or that it will result in any particular number of leads, jobs or revenue.
13. Limitation of liability
To the extent permitted by law: (a) we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, business opportunities, leads or data, even if advised of the possibility; and (b) our total liability for any claim relating to the service is limited to the fees you paid us in the three (3) months before the event giving rise to the claim.
14. Indemnity
You agree to indemnify us against claims, losses and reasonable legal costs arising from your use of the service in breach of these Terms or the law, including messages sent on your behalf.
15. Changes to these Terms
We may update these Terms. If a change is material, we will notify you by email or in your account at least 30 days before it takes effect. Continuing to use the service after that date means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. You and we agree to the exclusive jurisdiction of the courts of British Columbia.
